What do people mean when they say NARCOTICS offense?
One major category of offenses (on federal, state and municipal levels) is narcotics crimes. These offenses vary from misdemeanors to felonies which are punishable by life in prison, or even by the possibly by death. Narcotics crimes run the gamut from simple possession to possession with intent to distribute, to sale, to manufacture, to distribution, to trafficking, and the substances which are subject to these laws are plentiful (and are contained in various “schedules” which can be found in the state and/or federal statutes). Common examples of substances subject to narcotics crimes prosecution are (but are not limited to) marijuana, cocaine, heroin and extacy (or MDMA).
Narcotics cases generally implicate the 4th Amendment to the US Constitution (i.e. the protection against unreasonable searches and seizures) and are, in this writer’s opinion, the quintessential area of practice where a criminal lawyer actually gets to serve his or her client as a criminal lawyer.
