DUI / ALCOHOL

Alcohol related offenses generally include DUI (driving under the influence), disorderly intoxication and sale or contribution to underage drinkers. Although all of these matters are serious, perhaps the most popular of these offenses are those in the DUI arena.
DUI is a progressive offense (that is to say that the punishments grow incrementally stiffer each subsequent time that the same person gets arrested for another DUI offense), but DUI is also progressive in that there are varying levels of seriousness in DUI cases. The simplest form of DUI is what is referred to (in Florida anyhow) as a “1st minimum’s case”. This is a relatively simple DUI arrest which is predicated upon a normal traffic stop (i.e. for speeding, weaving, a broken tail light, etc.) and which turns into a DUI arrest after the officer smells an odor of alcohol (and typically makes other suggestive observations). A 1st minimum DUI can become more complicated when, for example, an accident is involved, and accidents can of course vary in terms of the seriousness of property damage and/or injury to persons (including the person arrested for DUI). Of course death can occur as a result of a DUI accident and in DUI related fatality cases are often linked with vehicular homicide charges.
