By strict definition, “criminal law” is that area of the law which, for the purpose of preventing harm to society, a) declares what conduct is criminal (i.e. what acts or omissions constitute offenses against a governmental entity), and b) prescribes the punishment possibly imposed for such conduct. In simpler parlance, however, “criminal law” is that area of law which deals with police / government conduct as it effects a given individual’s rights or freedom.
Criminal law becomes an issue from the moment that police (or other government agents) approach private citizens, and remains an issue all the way through the trial (and appellate) processes. Criminal lawyers can be instrumental (and perhaps even critical) across this entire spectrum.
Everyone who is approached by a police officer anywhere in the United States is afforded certain protections by the U.S. Constitution (as well as from other sources, i.e. various State Constitutions, statutes, etc.) and it is the sworn duty of the criminal lawyer to ensure, to the best of his or her ability, that those rights are respected by the government (and the Courts).
